Professional Liability (E&O) Insurance in Florida

Professional liability insurance, also called Errors & Omissions (E&O), covers claims that your professional services or advice caused a client financial harm. Even if you did not make a mistake, defending against the accusation costs money. This policy covers your legal defense, court costs, and settlements.

General liability vs professional liability

General liability covers physical injury and property damage. Professional liability covers financial losses from your professional services. A client who trips in your office is a general liability claim. A client who suffers a financial loss due to an error, omission, or oversight in your professional services is an E&O claim. Most professionals need both.

Professional liability for accountants and CPAs

Accountants face E&O claims from tax preparation errors, missed filing deadlines, and financial advice that leads to client losses. A single tax error can result in significant penalties for your client, and they will look to you for recovery. Most accounting firms carry E&O as standard practice, and many clients require it contractually before engaging your services.

Professional liability for real estate agents

Real estate agents face claims from failure to disclose property defects, contract errors, misrepresentation, and breach of fiduciary duty. In Florida's active real estate market, transaction volumes mean more exposure. Most MLS boards and brokerages require E&O coverage as a condition of membership or affiliation. This is one of the most common professional liability classes in the state.

Professional liability for therapists and counselors

Mental health professionals, including therapists, counselors, psychologists, and social workers, need professional liability coverage for malpractice claims, treatment disputes, and allegations of harm. This is distinct from general liability because it covers the professional services you provide, not physical premises risks. Many licensing boards and insurance panels require proof of professional liability coverage.

Frequently asked questions

Is professional liability the same as E&O?

Yes. The terms are used interchangeably. Both cover claims arising from your professional services, advice, or work product.

Is E&O required in Florida?

There is no single Florida statute requiring E&O for all professions, but several professions have regulatory or practical requirements. Florida insurance agents must maintain E&O coverage to hold carrier appointments (Florida Statute 626.8473 requires E&O for surplus lines agents specifically). Real estate agents typically need it for MLS board membership and brokerage affiliation. Architects and engineers need it for most project contracts. Many clients and licensing bodies require it even when state law does not.

What's the difference between claims-made and occurrence forms?

Claims-made covers claims filed during the policy period regardless of when the incident happened (as long as it is after the retroactive date). Occurrence covers incidents that happen during the policy period regardless of when the claim is filed. Most professional liability policies use claims-made form.

Can I add professional liability to my GL policy?

For many business types, yes. Some carriers offer a professional liability endorsement that can be added to GL policies for contractors, consultants, fitness professionals, and others. For architects, engineers, accountants, and similar professions, standalone E&O is recommended. You can also add cyber liability coverage to either GL or E&O policies, which is increasingly important for any business that handles client data electronically.

What's NOT covered by professional liability?

Criminal acts, intentional wrongdoing, bodily injury (that is GL), property damage to others (GL), employee injuries (workers comp), and claims arising from services outside your professional scope.

How long does claims-made coverage last after my policy ends?

Claims-made policies only cover claims filed while the policy is active. If you cancel or switch carriers, you may need an extended reporting period (also called a 'tail') to cover claims filed after cancellation for incidents that happened during the policy period. This is important to understand before switching E&O carriers.

Ready to protect your business?

Most Florida businesses can get an E&O quote in under 10 minutes. No paperwork, no phone calls unless you want them.
